1. Agreement

By accessing or using artmodels.ca (the "Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. These Terms constitute a binding agreement between you and artmodels.ca.

2. Who Can Use the Platform

You must be at least 18 years old to use artmodels.ca. This is a strict requirement with no exceptions. By using the Platform, you confirm that you are 18 or older and have the legal capacity to enter into this agreement.

You also represent that:

• You are located in Canada or can collaborate with members across Canada.
• If you intend to respond to paid opportunities, you are a resident of Canada or otherwise entitled to work in Canada.
• You have a genuine connection to the arts community as an artist, model, or arts enthusiast.
• All information you provide is accurate and complete.

Privacy Jurisdiction: By using artmodels.ca, you confirm that you are not a resident of the European Union and agree that this Platform is governed exclusively by Canadian privacy law (including PIPEDA), not the EU General Data Protection Regulation (GDPR). If you are an EU resident, you should not use this Platform.

3. What We Provide

artmodels.ca is a community platform connecting artists and models for artistic collaboration. We facilitate introductions and provide tools for communication, but we are not a talent agency, employer, or party to any arrangements made between users.

4. Your Account

You are responsible for your account credentials and all activity under your account. Keep your password secure and notify us immediately of any unauthorized access. We may require identity verification and reserve the right to reject or terminate accounts at our discretion.

5. Analytics and Platform Improvement

We collect and analyze usage data to improve the Platform, enhance user experience, and ensure the safety of our community. This may include information about how you interact with artmodels.ca, such as pages visited, features used, and general usage patterns.

By using the Platform, you consent to this data collection. We use this information to identify and fix issues, understand how our features are used, prevent abuse, and make improvements. For more details, see our Privacy Policy.

6. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation.
• Harass, abuse, threaten, or harm any person.
• Post hateful, violent, or pornographic content.
• Solicit sexual services or non-artistic escort services.
• Impersonate others or misrepresent your identity.
• Scrape, crawl, or automated data collection without authorization.
• Circumvent security features or interfere with Platform operations.
• Use the Platform for spam, fraud, or deceptive practices.

7. Your Content and Our License

You retain ownership of content you upload (portfolio images, profile information, messages, etc.). However, by uploading content to artmodels.ca, you grant us a permanent, worldwide, royalty-free, non-exclusive license to use, store, display, reproduce, modify, and distribute that content for any purpose related to operating, promoting, and improving artmodels.ca.

This license continues even if you delete content or close your account, as copies may exist in our backups, caches, or promotional materials created while your content was on the Platform. You confirm you have all necessary rights to grant this license.

We may remove any content that violates these Terms or our Community Guidelines.

8. Safety and Interactions

You interact with other users at your own risk. While we review profiles before granting access to messaging and posting, we do not verify users' legal identities, conduct background checks, or guarantee their intentions. artmodels.ca is not responsible for user conduct on or off the Platform, including any disputes, injuries, or damages arising from user interactions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTMODELS.CA AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO ARTMODELS.CA FOR SERVICES IN THE TWO (2) YEARS PRECEDING THE CLAIM.

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your expectations.

10. Termination

We may suspend or terminate your account at any time, with or without cause or notice. You may delete your account at any time through your account settings. Upon termination, your right to use the Platform ends immediately, but provisions that by their nature should survive (including our content license) will remain in effect.

11. Disputes and Governing Law

These Terms are governed by the laws of Alberta, Canada. Any legal action arising from these Terms or your use of the Platform must be brought exclusively in the Alberta Court of Justice located in Calgary, Alberta, and you consent to its jurisdiction.

You agree to waive and abandon any portion of a claim that exceeds the monetary jurisdiction of the Alberta Court of Justice. By using the Platform, you acknowledge this limitation and agree not to pursue claims in any other court or forum.

Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us. You waive any right to participate in class actions against artmodels.ca.

12. Changes to Terms

We may update these Terms at any time. Material changes will be announced with at least 30 days' notice. Continued use after changes take effect constitutes acceptance of the new Terms.
